The public could hear Trump-related disputes from Florida argued in real-time after the US Court of Appeals for the Eleventh Circuit announced Monday that it will livestream audio.
In what watchdog group Fix the Court called a “huge” move, the Atlanta-based court that hears appeals from Georgia, Florida, and Alabama said it will resume a practice that the group raised concerns about the circuit halting under a pandemic-prompted order to stream arguments not conducted in open court.
“The Court is pleased to announce oral arguments held in open court in all court locations will be live streamed—audio only—beginning October 25, 2022,” the Eleventh Circuit said Monday.
“Oral arguments in national security cases and other cases not heard publicly will not be live streamed and recordings of those arguments will not be posted on the Court’s website,” the circuit announcement said.
“Determinations as to whether a case involves matters of national security are made on a case-by-case basis,” Kate Adams of the circuit executive’s office told Bloomberg Law in an email Monday. “I cannot speak to whether the Court will designate a particular matter a national security case,” she said.
Litigation is pending in the circuit following the government’s August seizure of documents—including ones with classified markings—from the former president’s Florida estate.
The US Supreme Court, which streamed audio during the pandemic, has continued to do so as its new term began this month.
