An Arizona man’s estate lost a challenge to standard-of-care testimony given by his treating physicians in a medical malpractice case because it didn’t violate an Arizona rule limiting parties to one expert witness, the state’s top court said.
Arizona’s one-expert rule limits only the number of witnesses retained to give expert opinion testimony, the Arizona Supreme Court said. A fact witness, testifying based on personal observations, may offer opinions on the standard of care without violating the rule, it said.
